Background I purchased a Blue, unlocked, New, Samsung Galaxy S4 cell phone, on 2÷12÷16 from a Metro PCS authorized dealership called Metropolitan wireless group inc. The agents that sold the mobile phone was Tushar Chander(Indian gentleman in the picture). First Returned The first mobile phone I purchased from Tushar Chander was defective. My callers were not able to hear me when I want to talk with them. I returned the mobile phone on the same day to Tushar, and he replaced the Mobile phone for a «white, unlocked, New, Samsung Galaxy S4». Second Returned The second mobile phone was also faulty. At 10:30 pm, on 2÷12÷16, the mobile phone was not reading the SIM card. I restarted the mobile phone various time and, at last, my mobile phone read the SIM card. My cell phone would work for a few hours, but then it stopped reading the card and showing error. I again went back to Tushar on 02÷14÷16, and Tushar Chander only exchanged the SIM card. The Cell phone worked for a few hours and then stopped reading the SIM card again. Unfair Attitude I returned to the store on 02÷15÷16, and I spoke with sale agent Bradly to exchange my cell phone. He checked the cell phone and told me that the mobile phone is defective. He called Tushar in my presence and explained to him that the cell phone is defective not the physical SIM card. Tushar told Bradly the cell phone is fine is just a signal problem, but Bradly emphasize to him, he checked the sim card and the mobile phone. The mobile phone is defective. Tushar declined to exchange the mobile phone and directed Bradley to tell me to wait a few more hours to see if the phone works again. If it does not work, they were going to call the company where they purchased the phone to see what they would do for me. Refurbished Mobile Phone I decided to have my cell phone checked by another metro pcs store, and they stated the problem is not with the SIM card, its the mobile phone, but the cell looks used. She suggested me to call Samsung to find out if the mobile phone is refurbished. I called Samsung Customer Service, and they told me a shocking news that this phone is a refurbished cell phone. It was last used in 2014 and the manufacturing warranty expired in 2015. I’ve attached a copy of the ticket email sent to me showing warranty was expired. Demand to Refund my Amount I expressed to Tushar my findings and that I wanted a full refund, but he, however, refused to give me a refund or exchange the phone. He said that he spoke to the owner of the company, and they agree to give me compensation in the form of offering a deal, «new Samsung Galaxy S5 for an additional $ 99.00. Unlawful Behavior Simply the store agent and owner of the store are committing fraud, by overcharging customers, claiming on selling new mobile phone but in fact they are refurbished and by refusing to follow throw with metro pcs store policy and rules. Demand Unfortunately, due to the fraud committed by Tushar Chander and owner of the store I had to finance a new mobile phone from another store. Which makes it more affordable for me than paying full price for a cell phone again. I’ve been a customer of Metro PCS since 7÷30÷2009 and is unfortunate that I have to leave this company for this reason. I also want to bring to your attention that Tushar charged my bank account $ 489.00 instead of $ 488.81 written on my receipt. To say the least they are scammer here. The correct name to this dealership is Metropolitan Wireless(Lawrence) Group inc. ID# 271462561 If your even in this situation dispute the transaction with your bank and stop all payments first. Then processed with what ever actions you choose.
