I fired my first attorney and hired Roger P Foley, as my attorney in a bogus assault and battery charge and it was the best thing I ever did!
Let me first begin on the case. I went into a bar in South Beach, called an Über and while waiting for an Über, saw two pretty ladies outside of the by the corner of the bar building. I began talking to them and two guys came up to me and stated that the ladies were their girlfriends.
Needless to say the ladies denied it, shaking their head in denial of the claim that these two guys were making. I ignored the two guys and continued talking to the ladies.
Next thing I know one charged at me and knocked me into the bushes while trying to choke me.
I was able to get out and began to defend myself. The bouncers from the bar, came out and attacked me from behind, placed me in a choke hold and put me in the ground. One even had his knee in my neck.
Of course MBPD comes and arrest me– no one saw anything except me defending myself. They never read me my Miranda rights and I spent the night in jail for surviving an attack!
The DA wanted to give me 12 months and the first lawyer did nothing to fight for my innocence.
I sent the other attorney video and pictures of where the attack happened and where there are cameras around. We even highlighted where the video cameras were at and they did not try and get the video immediately, instead waited over a month and could not get anything, because the video looped through. I sent the photos of my injuries, to show where the attacker grabbed my throat, as well as the bushes and bruises from being pushed into the bushes to the other attorney– I find out that the other attorney never turned in the photos of my injuries to prove self– defense. Once the other attorney started talking like I should just take plea to a crime I did not commit but rather I was a victim of, I knew it was time to move on and hire someone who would fight for me.
That is where Roger comes in.
Straight forward and to the point, he was a life saver. He took in all of the evidence and he cross examined the DA’s witness only to find out that the DA had the wrong witness to my case! Had Roger not believed in me, I could have been an innocent man in jail.
The DA wanted to reschedule to get the «correct» witness and Roger argued that sufficient time was given and wasted. The judge agreed and dismissed the case!
I know in my gut that the other lawyer would not have fought for me the way Roger did. Heck the other lawyer did not even submit the photos as evidence, so I know firing that other money waster attorney and hiring Roger P Foley was the smartest thing ever. My freedom depended on it.
